Major daily newspapers up and down the state are urging the Legislature to defeat AB 350. It seems the rhetoric used to push the bill is as transparent to them as it is to people in our industry, and the bill is being called everything from “perverse” to “frivolous” to “just plain wrong.”

The SF Chronicle is one of the latest to blast the bill, “Jerry Brown should veto union job-protection bill.”

California's economy is still struggling. Unemployment is near 12%. The legislature has real problems to address, like creating jobs and reviving our economy. But instead of solving real problems, some legislators are pushing misguided legislation - AB 350 by Assemblyman Jose Solorio (D-Santa Ana) - that puts government in charge of who private businesses can hire. AB 350 forces businesses to discriminate against their current employees and seriously erodes businesses' ability to control the quality of their work product.

AB 350 one of the most far-reaching pieces of legislation to impact the commercial property industry in a long time, will be voted on next week in the Senate Appropriations Committee, and possibly the Senate Floor. After that, this inexpedient bill could be on its way to the governor.

UPDATE: BOMA Defeats AB 350 in Unprecedented Vote

UPDATE - September 10, 2011

Great news from Rex Hime and Matthew Hargrove, our lobbyists with BOMA California in Sacramento!

AB 350, the measure that required employees to be retained for 90 days even when the vendor company providing service to your building is dismissed went down to defeat – not once, not twice but five times in the wee hours of Saturday.  Proponents finally conceded defeat.

This is a historic victory that positioned the business community, led by CBPA and the Chamber, against the most powerful public employee union in the country – the SEIU. There will be more details to follow but kudos to our lobbyist Matthew Hargrove and his California Chamber of Commerce partner as well as the public affairs firm financed by BOMA California -  BCF Public Affairs. The 20 newspaper editorials around the state espousing our position were a tremendous help. And huge kudos for all the local involvement from members around the state who made phone calls, sent letters and had meetings with elected officials.

At 12:59 a.m. this morning, on an unprecedented 7th vote in the past two days, AB 350 (Solorio) was defeated as one of the final acts of the California Senate’s 2011 Legislative Year.

The bill died on a bipartisan vote, 17 ayes – 18 noes (21 needed to pass).

This was one of the hardest fought battles of the end of this Session.

Please send a personal note of “thanks” now to any office for which you made a personal contact is encouraged.  Thank all of YOU for the hard work you put into this effort.  Many people, companies, real estate and business groups, as well as a few non-business organizations worked together to defeat this bill.  This would not have happened without such a large organized mobilization as well as the high profile media coverage the coalition was able to generate.

A special thank you to Jennifer Barrera at the CalChamber is deserved, as she not only employed her legal skills on analysis of the bill and case law, but also tenaciously worked the bill on our behalf in the Halls of the Capitol from last April until the bitter end last night.

UPDATE: Call to Action! Oppose CA Assembly Bill 350



UPDATE - June 6, 2011

AB 350 which creates a protected class of building services employees – employed with private sector companies – passed the California State Assembly last week.

Should this bill be signed into law, tenants and property managers will not see a change in the staff responsible for day-to-day services when they hire a new company. And new companies – union or non-union – will be forced to take on employees that they have not screened and who may not be up to the required tasks.

AB 350 is extremely unfair to productive workers as it would displace employees who work for a service provider that has successfully competed for a new contract with employees from the previous company that lost the job -- even if the reason for losing the contract was poor performance of the now protected employees.

The measure now moves to the Senate, where BOMA California will work hard both in Sacramento and in the various Senate districts to defeat this measure.

The commercial real estate industry is facing a continued threat from Assembly Bill 350 (AB 350) introduced by Assemblymember Jose Solario (D, Santa Ana) in the California Legislature. This measure has the possibility of being voted on the Assembly Floor as early as May 31, 2011.

What Will This Bill Do, If Enacted?

This bill would extend existing law requiring janitorial contractors to retain employees who were employed at the site by the previous contractor for at least 60 days to an additional number of services utilized by building owners, including security, building maintenance, landscaping, and window cleaning.

BOMA California needs your help! Please take a moment to fax a letter, write an email, or call the California Assemblymembers and Senators (contact if information, below) to express your opposition to this legislation NO LATER THAN CLOSE OF BUSINESS ON MAY 31, 2011.

Why Oppose This Measure?

1. It ties management's hands forcing them to retain workers from a previous employer, and undermining California's at-will employment presumption;

2. It extends the current Displaced Janitor law from 60 days to 90 days;

3. It ensures that the incumbent union will remain the bargaining representative under the "successor employer" doctrine - regardless of whether the successor employer has a collective bargaining agreement or not. The decision to unionize a business should be made following the procedures outlined in the National Labor Relations Act, and not forced on either party, employer or employee, through legislation;

4. This legislation would pass on the liability of employing undocumented workers to successor employers, thus potentially forcing employers to break Federal law to comply with State law.

BOMA San Francisco Members: 

Please help BOMA California oppose a bill that poses a major threat to your business. AB 350 (Jose Solorio; D-Santa Ana) in the California Legislature would expand existing law requiring janitorial contractors to retain employees who were employed at the site by the previous contractor for at least 60 days to a number of services utilized by building owners, including security, building maintenance, landscaping, and window cleaning, and extend the time period of retention to 90 days.

Please contact your local Assemblymembers (find them by clicking here) and ask them to oppose this measure. 

Rationale:
  • The state should not make individual employment decisions for our industry. 
  • It ties management's hands forcing it to retain workers from a previous employer, and undermining California's at-will employment presumption. 
  • It ensures that the incumbent union will remain the bargaining representative under the "successor employer" doctrine - regardless of whether the successor employer has a collective bargaining agreement or not.
