Supervisor Scott Wiener Honored as BOMA San Francisco's Public Official of the Year




BOMA San Francisco Members:

Supervisor Scott Wiener was honored with BOMA San Francisco's Public Official of the Year award for 2013 at the October 24th BOMA general membership luncheon at the City Club.  The award is given annually to an individual who epitomizes BOMA San Francisco's Public Policy Principals.

Scott believes in improving San Francisco's foundation: maintaining and rebuilding our infrastructure, reforming and revitalizing our transportation systems, ensuring neighborhood safety, supporting our system of public education, and creating an atmosphere of job creation so that we build our tax base. Focusing on these core issues will allow San Francisco to flourish as the beacon of innovation, hope, and tolerance that draws people from all over the world to live, work, and visit the City.

In his acceptance speech, Supervisor Wiener kindly mentioned his long-term, collaborative relationship with BOMA San Francisco members and staff.  A recent example of this was the two year discussion with BOMA members and various stakeholders to amend the existing mobile food facilities (food truck) law.  Our members appreciate Mr. Wiener's intrepid leadership in helping all parties come to an agreement.

Mr. Wiener also spoke about how he is focused on addressing the long term issues that are plaguing San Francisco.  For example, rising housing costs are at the top of his list, "affordable housing for all residents is important to the overall economic and social vitality of the City," said Wiener.  Funding and improving public transportation is another matter Supervisor Wiener is championing at City Hall.

BOMA San Francisco Advocacy Committee Update - Government Affairs Policy Advisory Committee (GAPAC)


BOMA San Francisco Members,

The members of BOMA San Francisco's Government Affairs Policy Advisory Committee (GAPAC) have been active reviewing local policy measures that relate to the commercial real estate industry and meeting with those who determine public policy for all San Franciscans.  The following is a brief report of their activities over the last few months.

GAPAC educates and informs BOMA members, elected and administrative officials, and the public about issues of significance to commercial real estate, and BOMA’s positions on those issues.

UPDATE: San Francisco Mobile Food Facilities Permits


UPDATE - June 28, 2013

Today, San Francisco Mayor Ed Lee signed legislation that will address deficiencies in the current Mobile Food Facilities law for future permit applications. Details below.
The legislation was negotiated over a two year time frame and lead by Supervisor Scott Wiener.  BOMA San Francisco members thank Supervisor Wiener and his staff, the Golden Gate Restaurant Association, Off the Grid and other stakeholders for their input and patience during this process.

UPDATE - June 7, 2013

Please review the revised draft legislation governing future Mobile Food Facilities (MFF or mobile food truck) permits in San Francisco that will be heard at the Land Use and Economic Development Committee next Monday at 1:30 p.m.  Email kenc@boma.com if you can attend and voice your opinion regarding the legislation. It is an improvement on the law, but it will not change the conditions for the current permit holders.

Here are the major changes from the current law that were successfully negotiated by BOMA members and various stakeholder groups:

Permit Issuance and Property Owner Notification
  • Permit notification radius will be 75 feet - it was 300 feet.
  • New permit applications shall require that a notice be posted on a utility pole close to the proposed MFF location for at least 10 calendar days prior to the close of the appeal period. The building owner/manager and the property owner of record (if different) of each building address within the 75 foot area shall also be notified, as well as all first floor commercial businesses and any certified neighborhood organization listed on the San Francisco Planning Department’s website. 
  • MFFs may not sell any good, wares, or merchandise other than food or drink intended for human consumption
  • New permits issued after July 1, 2013 will expire seven years from the permit issuance date.  The permittee can apply six months prior to the expiration date for a new permit and shall be given priority over other applicants.
Location
  • 75 foot buffer from the primary entrance of a restaurant.
  • Locations may not be secured for more than three 24 hour cycles, or portions thereof, within a one week cycle. 
  • No parking next to a city park unless given specific permission from the Recreation and Parks Department.
  • Allowance for MFFs to park closer (1,000 feet vs. 1,500 feet) to schools with a number of specific schools listed in the legislation granting a 750 foot distance.
General
  • Formula retail restrictions will apply.
  • The operating permit shall be conditioned on the MFF vendor obtaining a Department of Public Health Certificate of Sanitation and a Fire Department permit.  If the Public Health or Fire Department permits are not secured within 3 months, the MFF permit shall be automatically revoked. 
  • No freestanding A-frame display, sign, or other obstruction on the public right of way will be allowed except refuse collection receptacles. 
  • Permits are allowed to be sold (transferred) with approval of the Department of Public Works (DPW), but no new notice to nearby businesses is required. 
  • The DPW Director may revoke or suspend MFF permits for other public purposes such as bike lanes, traffic reconfiguration, bulb-outs, bus stops, etc.  In such circumstances, the Director shall strive to authorize a temporary or permanent relocation comparable to the original site. 
  • This measure includes fines that  have been increased substantially for administrative violations - from $300 a day to $1,000 a day. MFFs operating without a permit shall be subject to penalties up to $5,000 a day - up from $1,000.

The various stakeholders, including BOMA San Francisco, met recently with Supervisor Scott Wiener to discuss a compromise solution to the existing state of Mobile Food Facilities in San Francisco. BOMA members are interested in legislative reform that includes:
  • A reasonable distance of 75 feet between street parked food trucks.
  • Permit expiration time frame - none exists at present.
  • Notification of permit application to the property owner of record.
More information, including an updated draft of the legislation will be available from the City Attorney's office in the near-term for BOMA member review.

These measures, in aggregate, will amend existing regulations for Mobile Food Facilities (MFF or food trucks) to eliminate the current 'like food' consideration for appeals to MFF permit applications.  Indeed, it's the only consideration for a permit appeal at present - i.e., a food truck selling like food that is similar to an adjacent brick and mortar establishment.  The ordinance will also specify distances between trucks, the parking duration and add significant areas throughout San Francisco for MFF operators to sell food.

BOMA San Francisco Leaders Meet with San Francisco Supervisor Katy Tang



BOMA San Francisco Members:

BOMA leaders welcomed San Francisco's newly appointed District 4 Supervisor, Katy Tang recently. Supervisor Tang was appointed by Mayor Ed Lee to serve on the Board of Supervisors in February.

The meeting was a productive one whereby BOMA members and Supervisor Tang had an opportunity to get to know one another.  Public policy issues discussed included:
About Katy Tang

Katy Tang previously served as Supervisor Carmen Chu’s Legislative Aide for over five years, drafting legislation to create Neighborhood Commercial Districts for District 4 business corridors, increasing protections for victims of domestic violence, streamlining complex City contracting processes, facilitating prompt payment to City contractors, and instituting increased penalties for crimes committed in and around public transit.

As Legislative Aide, Tang served as an adviser on policy issues before the Board of Supervisors, analyzed legislation, served as lead staff in developing the City’s first two-year budget that balanced a $6.8 billion annual City budget and closed budget shortfalls of $380 million, and worked with District 4 neighbors and businesses to implement community improvement projects, including the completion of a pilot Storefront Improvement Project on Noriega and Taraval streets that improved 15 neighborhood businesses and created a model for small businesses Citywide. Katy also spearheaded efforts to assist small businesses in complying with the Americans with Disabilities Act requirements, helping to create access for all San Franciscans and protect businesses. 

Supervisor Tang is lifelong District 4 resident.

The issue of Mobile Food Facilities (Food Trucks) was discussed on KQED's Forum radio program recently. Forum participants included:

BOMA San Francisco's Advocacy Team is working with Supervisor Scott Wiener to help address the proliferation of Food Trucks in the Financial District and other issues raised by the various stakeholders.  We will continue to update BOMA members on the progress of the dialogue in future blog posts. NOTE - the San Francisco Department of Public Works (SFDPW) has initiated the posting of the Notices of Intent for Mobile Food Facilities.  Please bookmark this webpage  and continue to check it for updated information going forward: http://www.sfdpw.org/index.aspx?page=1463.  The webpage includes the following data:
Your BOMA San Francisco Advocacy team is working tenaciously with BOMA members, Supervisor Scott Wiener and his staff (who have been very helpful!) and the SFDPW staff to assuage the various issues that BOMA members have had - specifically ground floor retail tenants - with regard to the proliferation of Mobile Food Facilities in the Financial District and adjacent Districts.

We look forward to our next meeting with all stakeholders and will notify BOMA members in a future blog post of the meeting date, time and possible discussion points.

Any interested party may request additional information or file an objection to the proposed MFF by contacting, in writing, or in person, the Department of Public Works, Bureau of Street-Use and Mapping, 875 Stevenson Street, Room 460, San Francisco, CA 94103 or by telephone at (415) 554-5810.

If you are a potential interested party within 300 foot radius of the proposed location, you have the right to object to the issuance of the Mobile Food Facility Permit. To exercise your rights, you must provide written objection within thirty (30) calendar days of the date of the letters to the Department of Public Works, Bureau of Street-Use & Mapping, 875 Stevenson Street, Room 460, San Francisco, CA 94103 Attn: Mobile Food Facility expressing your concerns and objections. Your envelope must be postmarked no later than date listed in the letter.
